Waitlist Terms and Conditions

Effective as of the date this page is first published, and as updated thereafter.

1. Introduction and Scope

These Waitlist Terms and Conditions ("Waitlist Terms") govern your participation in the Lumaat waitlist at this page. They apply only to the waitlist itself and do not govern use of the Lumaat mobile application. Once the app launches, your use of it will be governed by a separate Terms of Service and Privacy Policy, which you will be asked to accept at that time.

2. Eligibility

You must be at least 18 years old to join the waitlist. By joining, you confirm that you meet this requirement and that the information you provide is accurate.

3. Waitlist Participation

The waitlist is open to signups worldwide. Joining does not guarantee you a spot, early access, a specific launch date, specific pricing, or any particular feature set, and does not guarantee that the app will be available in your country or region at launch. Lumaat is under development, and any of these may change or be delayed. Lumaat may modify, pause, or end the waitlist program at any time, for any reason, without liability to you.

4. Information We Collect and How We Use It

When you join the waitlist, we collect the name and email address you provide. We use this information to notify you when Lumaat launches and to send occasional related updates, as described in our Privacy Notice. We do not collect payment information as part of joining the waitlist, and joining does not create any billing relationship between you and Lumaat. Because the waitlist is open globally, your information may be transferred to and processed in Canada, where our database is hosted, as described in our Privacy Notice.

5. Communications and Consent

By checking the consent box on the waitlist form, you agree to receive emails and messages about Lumaat, including launch notifications and occasional related updates. You can withdraw this consent at any time by using the unsubscribe link in any email or by contacting us directly. See our Privacy Notice for full detail on how your information is stored, used, and retained.

6. Prohibited Conduct

You agree not to use automated tools or scripts to join the waitlist, submit false or misleading information, or create multiple waitlist entries for the same person. This prohibition also applies to any referral or priority-access feature described in Section 7. We may remove any entry we reasonably believe violates this section.

7. Future Referral or Priority Access Features

We may introduce referral or priority-access features in the future, allowing waitlist members to move up in access order or invite others. If we do, additional terms specific to that feature will be posted at that time and will govern its use. No such feature exists as of the date of these Waitlist Terms.

8. Testimonials and Feedback

Joining the waitlist and consenting to communications under Section 5 does not authorize us to use your name, feedback, or likeness in marketing. If we would like to feature your feedback publicly, such as a testimonial, we will ask for your separate permission before doing so.

9. No Warranties

The waitlist and any related communications are provided "as is," without warranties of any kind. We do not guarantee that the waitlist will be available without interruption or error.

10. Limitation of Liability

To the fullest extent permitted by law, Lumaat will not be liable for any damages arising from your participation in the waitlist, including any delay, change, or discontinuation of the waitlist or the app itself. Because joining the waitlist involves no payment to Lumaat, our total liability under these Waitlist Terms is limited to zero dollars.

11. Termination and Removal

We may remove you from the waitlist at any time, including for an invalid email address or a violation of these Waitlist Terms. You may request removal from the waitlist at any time by contacting us using the information below.

12. Changes to These Waitlist Terms

We may update these Waitlist Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Continuing to remain on the waitlist after a change means you accept the updated Waitlist Terms.

13. Governing Law

These Waitlist Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. This does not remove any protection you are entitled to under mandatory consumer protection laws of the country or region where you live, where such laws apply and cannot be waived.
